AVYRON Clothing – Terms of Service

Last updated: November 1, 2026

1. General Information and Scope

Welcome to AVYRON Clothing.

These Terms of Service ("Terms") govern your access to and use of the AVYRON Clothing online store at https://avyron.pro, including all purchases made through our online store.

The online store is operated by:

Seller: Hans-Jörg Bogdanov
Business name: AVYRON Clothing
Legal form: Sole proprietorship
Business address: Dachweg 13, 27777 Ganderkesee
Email: avyronclothing@gmail.com
Telephone: +49 1521 2863406
Country of establishment: Germany

In these Terms, "we", "us" and "our" refer to AVYRON Clothing. "You" and "your" refer to the customer or visitor of our online store.

Our store is hosted on Shopify, which provides the e-commerce platform used to sell our products.

These Terms apply to all orders placed through our online store, subject to mandatory consumer protection laws applicable in the customer's country of residence.

If any provision of these Terms conflicts with mandatory consumer protection law, the mandatory legal provisions shall prevail.

2. Products and Product Information

AVYRON Clothing offers clothing and fashion products featuring designs created or selected by us.

Our products may be manufactured on demand by third-party production partners after an order has been placed.

We make reasonable efforts to display product descriptions, photographs, colours, sizes and other product details as accurately as possible.

Please note that:

  • Colours may appear slightly different depending on your screen, device and display settings.

  • Product photographs may show examples or mock-ups of the actual products.

  • Minor variations in colour, positioning or manufacturing may occur within normal production tolerances.

Such minor variations do not affect your statutory rights if a product does not conform to the contract.

Product descriptions, availability and prices may be updated from time to time. Any changes will not affect orders that have already been accepted, except where a correction is legally permitted.

3. Orders and Contract Formation

By placing an order through our online store, you submit an offer to purchase the selected products.

After submitting your order, you will normally receive an automated order confirmation by email. This confirmation acknowledges receipt of your order and does not necessarily constitute acceptance of your offer.

A purchase contract is concluded when we expressly accept your order, for example by sending an order acceptance or shipping confirmation, or otherwise confirm that the order is being processed, as applicable under the checkout process.

We reserve the right to refuse or cancel an order where there is a legitimate reason, including:

  • The product is unavailable.

  • A pricing or product description error has occurred.

  • Payment cannot be authorised.

  • There is a reasonable suspicion of fraud or misuse.

  • Delivery to the selected destination is not possible.

If payment has already been collected for an order that we cancel, we will refund the amount paid without undue delay.

Please check your order details carefully before completing checkout. Once an order has entered production, changes or cancellations may no longer be technically possible. This does not affect any statutory right of withdrawal or other mandatory consumer rights.

4. Prices, Taxes and Payments

All prices are displayed in the currency indicated in our online store.

The total price payable, including applicable delivery charges and other mandatory costs known to us, will be displayed before you submit your order.

AVYRON Clothing operates under the small business VAT scheme pursuant to Section 19 of the German VAT Act (Umsatzsteuergesetz), where applicable.

Accordingly, German VAT is not separately charged or shown on invoices for transactions covered by this scheme.

For international orders, customs duties, import taxes or other charges may apply depending on the destination country and the applicable legal and tax requirements. Any such charges that are payable by the customer will be communicated where required by law.

We accept the payment methods displayed during checkout. Payment processing may be handled by third-party payment service providers.

You confirm that you are authorised to use the selected payment method and that the payment information provided is accurate and complete.

5. Production, Shipping and Delivery

Our products may be manufactured and fulfilled by independent third-party production and shipping partners, including Printify and its production providers.

Production and delivery times displayed in our store are estimates unless a specific delivery date has been expressly agreed.

We will make reasonable efforts to ensure that orders are processed and delivered within the indicated timeframe.

Unless a different delivery period has been expressly agreed, statutory delivery deadlines apply.

We are responsible for the delivery of products to you. For consumer purchases, the risk of accidental loss or damage generally passes to you only when you, or a third party designated by you who is not the carrier, receive the goods.

The risk may pass earlier only where you independently appoint a carrier that we have not offered or designated.

We are not responsible for delays caused by circumstances beyond our reasonable control, to the extent permitted by applicable law. This does not affect your statutory rights, including rights arising from non-delivery or delayed delivery.

Further information about shipping destinations, delivery estimates and shipping costs is available in our Shipping Policy.

6. Right of Withdrawal and Returns

Consumers may have a statutory right to withdraw from a distance contract without giving a reason.

For consumers covered by EU or German withdrawal rules, the withdrawal period is generally 14 days from the day on which the consumer, or a third party designated by the consumer other than the carrier, receives the goods.

The detailed withdrawal conditions, procedure, applicable deadlines and model withdrawal form are provided separately in our Withdrawal Policy.

Our products are generally standard products featuring designs selected by AVYRON Clothing. Selecting a standard size or colour does not by itself exclude the statutory right of withdrawal.

If you exercise your statutory right of withdrawal, you may be responsible for the direct return costs where this has been properly disclosed before the purchase and applicable law permits it.

Nothing in these Terms limits any statutory right of withdrawal, return or refund.

7. Legal Warranty and Defective Products

We are responsible for ensuring that products comply with the contract and applicable statutory requirements.

If a product is defective, damaged, incorrect or otherwise does not conform to the contract, you may be entitled to statutory remedies.

Depending on the applicable law and circumstances, these remedies may include:

  • Repair or replacement.

  • A price reduction.

  • Termination of the contract and a refund.

  • Compensation where legally applicable.

For consumers in the European Union, statutory conformity rights generally provide a minimum legal guarantee period of two years from delivery for new goods, subject to applicable national law.

These rights apply regardless of whether a product was manufactured by AVYRON Clothing or by a third-party production partner.

Please contact us at avyronclothing@gmail.com if you receive a defective or incorrect product. We may request photographs or other reasonable information to assess the issue.

We will not require you to give up any statutory rights as a condition of submitting a complaint.

8. Intellectual Property

All content made available through our online store, including designs, graphics, logos, photographs, product descriptions, text and other materials, is owned by or licensed to AVYRON Clothing unless otherwise stated.

Such content is protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, publish, commercially exploit or otherwise use our designs, branding or other protected content without our prior written permission, except where permitted by law.

Purchasing a product does not transfer ownership of any intellectual property rights associated with its design or branding.

9. Third-Party Services and Providers

Our online store may use third-party services and providers, including:

  • Shopify for the e-commerce platform.

  • Printify and its production partners for product manufacturing and fulfilment.

  • Payment providers for payment processing.

  • Shipping carriers for delivery.

These providers may process information or perform services necessary to complete your order.

Your purchase contract is nevertheless concluded with AVYRON Clothing, not with Shopify or Printify.

We remain responsible for our contractual obligations towards you, including applicable consumer rights.

Third-party services may be subject to their own terms and privacy policies. Those terms do not reduce your statutory rights against us.

10. Privacy and Personal Data

We process personal data in accordance with our Privacy Policy and applicable data protection laws, including the General Data Protection Regulation (GDPR), where applicable.

Personal data may be processed for purposes including:

  • Processing and fulfilling orders.

  • Arranging payment and delivery.

  • Communicating with customers.

  • Handling returns, refunds and complaints.

  • Preventing fraud and complying with legal obligations.

Where necessary, personal data may be shared with Shopify, Printify, payment providers, shipping carriers and other service providers involved in operating our store.

Further details are available in our Privacy Policy:

https://avyron.pro/policies/privacy-policy

11. Customer Reviews and Feedback

If you submit a product review, suggestion or other feedback, you grant AVYRON Clothing a non-exclusive, worldwide, royalty-free licence to use, reproduce and display that content for purposes connected with operating and promoting our store.

This licence does not transfer ownership of your content.

You confirm that you have the necessary rights to submit the content and that it does not unlawfully infringe the rights of another person.

We may remove or decline to publish content that is unlawful, misleading, abusive or otherwise inappropriate, subject to applicable law.

12. Errors and Corrections

We make reasonable efforts to ensure that information in our online store is accurate.

Occasionally, errors may occur in product descriptions, prices, availability, promotions or shipping information.

Where an error materially affects an order, we will contact you and explain the available options.

We will not unilaterally change an accepted order or retain payment for an order that cannot be fulfilled without providing any refund required by law.

13. Acceptable Use

You agree to use our online store only for lawful purposes.

You must not:

  • Use the store for fraudulent or unlawful activities.

  • Attempt to interfere with the operation or security of the store.

  • Upload or transmit malicious software.

  • Infringe intellectual property or other legal rights.

  • Use the store to distribute spam or harmful content.

  • Attempt to gain unauthorised access to accounts, systems or data.

We may restrict access to our services where there is a legitimate reason, including misuse, fraud or a material breach of these Terms.

Any restriction will be proportionate and subject to applicable law.

14. Suspension and Termination

We may suspend or restrict access to our online services where reasonably necessary for security, legal compliance, fraud prevention or protection against misuse.

Termination or suspension of access to the online store does not affect rights and obligations arising from purchase contracts already concluded.

Any statutory consumer rights remain unaffected.

15. Limitation of Liability

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

We are liable without limitation for:

  • Intentional misconduct and gross negligence.

  • Injury to life, body or health caused by our fault.

  • Liability under mandatory product liability legislation.

  • Any other liability that cannot legally be excluded or limited.

In cases of slight negligence, our liability is limited to breaches of essential contractual obligations, where legally permissible. In such cases, liability is limited to the foreseeable damage typical for the contract.

An essential contractual obligation is an obligation whose performance is necessary for the proper execution of the contract and on whose fulfilment you may ordinarily rely.

Nothing in this section affects your statutory consumer rights.

16. Force Majeure

We shall not be responsible for a failure or delay in performing our obligations to the extent that it is caused by circumstances beyond our reasonable control and where the applicable law permits such relief.

Such circumstances may include natural disasters, war, governmental measures, widespread transport disruptions, labour disputes or major infrastructure failures.

We will take reasonable steps to minimise the effects of such circumstances.

This section does not remove any mandatory rights you may have in relation to delayed delivery, cancellation or refunds.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

Any invalid provision will be replaced or interpreted in accordance with the applicable mandatory legal requirements.

Nothing in this section allows a provision to be enforced against a consumer where mandatory law prohibits it.

18. Entire Agreement

These Terms, together with the policies expressly referred to in them and the information provided during checkout, govern the contractual relationship between AVYRON Clothing and the customer.

They do not exclude or restrict any mandatory rights granted by applicable consumer protection laws.

19. Changes to These Terms

We may update these Terms from time to time to reflect changes in our business, services or legal requirements.

The version applicable to an order is the version in force when the relevant purchase contract is concluded, unless a change is required by law or otherwise validly agreed.

Updated Terms will be published on this page with a revised update date.

20. Governing Law and Consumer Rights

These Terms are governed by the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG), where legally permissible.

If you are a consumer habitually resident in another country, this choice of law does not deprive you of the protection afforded by provisions of the law of your country of residence that cannot be derogated from by agreement under applicable law.

Nothing in these Terms prevents you from bringing proceedings before a court that has jurisdiction under mandatory consumer protection rules.
